Final Jeopardy Explanation – Wednesday, April 12 2023
The Eighth Amendment states that “Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted“.
According to one interpretation, this amendment was a reaction to the “Bloody Assizes,” a series of treason trials and mass executions that began on August 25, 1685, in Winchester, following the Battle of Sedgemoor, which ended the Monmouth Rebellion in England.
The Titus Oates case in England, which resulted in several people being executed after Oates made false accusations against them, also served as a major inspiration for the clause. Titus Oates was prosecuted for multiple acts of perjury after King James II’s ascension in 1685. The Oates case subsequently became a subject of Eighth Amendment law developed by the U.S. Supreme Court. Ordinary sanctions were collectively meted out to Oates in a barbaric, excessive and bizarre manner.
