Final Jeopardy Explanation
The Eighth Amendment provides that “Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted“.
A view holds that this amendment was a reaction to to the “Bloody Assize” which were a series of treason trials and mass executions that began on August 25, 1685, at Winchester, following the Battle of Sedgemoor, which ended the Monmouth Rebellion in England.
The Titus Oates case in England, where he was convicted for numerous acts of perjury after King James II’s arrival in 1685 and resulted to the execution of numerous people he had wrongfully implicated, also served as a major inspiration for the provision. In the end, the Oates case was a subject of Eighth Amendment law on the part of the U.S. Supreme Court. The way that Oates was punished involved the collective application of regular sanctions in a barbaric, excessive and bizarre manner.
